The companies land a plasma record one week and a nine-figure funding round the next, and almost every press release carries a delivery date sitting a comfortable decade out. State regulators publish far less, so when one of them speaks up, the words tend to carry actual legal weight.<\/p>\n<p>On Monday, August 31, Tennessee Governor Bill Lee joined the Tennessee Department of Environment and Conservation at a meeting of state radiation regulators in Nashville to <a href=\"https:\/\/www.eastridgenewsonline.com\/governor-bill-lee-tdec-announce-first-license-for-commercial-fusion\/\" target=\"_blank\" rel=\"noopener nofollow\">announce<\/a> that TDEC had issued the state&#8217;s first fusion-specific byproduct material license to Type One Energy. Tennessee became the first state in the country to issue a license under a regulatory framework written specifically for fusion machines, and the paper points at a commercial project inside the Tennessee Valley Authority&#8217;s retired Bull Run coal plant near Oak Ridge.<\/p>\n<p>Nobody has ever held one before.<\/p>\n<p>The machine it clears the way for is a stellarator, the twisted cousin of the tokamak, and Type One wants 400 megawatts of electricity out of it. The site it lands on pushed 865 megawatts of coal power into the grid until 2023. Nobody has finished proving the physics between those two numbers. The license means Tennessee will let Type One try anyway, on state-inspected ground.<\/p>\n<h2>Tennessee wrote its own rulebook first<\/h2>\n<p>The Nuclear Regulatory Commission voted unanimously in 2023 to regulate fusion under its byproduct material framework, the same scheme that covers particle accelerators and hospital nuclear medicine, and that choice handed day-to-day oversight to the states. Washington used its existing radioactive materials rules to license <a href=\"https:\/\/www.autonocion.com\/us\/helion-fusion-energy\/\" target=\"_blank\" rel=\"noopener\">Helion&#8217;s Orion plant<\/a> back in June. Tennessee took a longer road. TDEC&#8217;s Division of Radiological Health wrote a licensing program built for fusion machines from scratch, the <a href=\"https:\/\/www.tn.gov\/environment\/news\/2026\/6\/1\/tn-powers-up-first-in-the-nation-fusion-regulations-june-9.html\" target=\"_blank\" rel=\"noopener nofollow\">rules went live on June 9<\/a>, and Monday&#8217;s license is the first one any US state has issued under a framework of that kind. The state rule defines a fusion machine as anything that transforms atomic nuclei through fusion and directly captures what comes out, whether that arrives as particles, heat, or radiation, so the wording covers a stellarator and most of the other geometries chasing the same prize.<\/p>\n<p>Type One and TVA filed the first application under the program on <a href=\"https:\/\/www.world-nuclear-news.org\/articles\/type-one-energy-initiates-licensing-of-fusion-power-plant\" target=\"_blank\" rel=\"noopener nofollow\">January 29<\/a>, and the license came through seven months later. Gov. The unit fed 865 megawatts into the grid at its rating, and TVA said the 765 megawatts it managed in summer covered more than 440,000 homes. Fifty-six years of coal ended when the plant burned through its final stockpile in a 48-day run in August 2023 and came offline that December.<\/p>\n<p>Two machines are already moving into the empty complex, and <a href=\"https:\/\/www.autonocion.com\/us\/coal-plant-turbine-hall-two-machines\/\" target=\"_blank\" rel=\"noopener\">neither one generates a watt<\/a>. Eaton is converting the old generator hardware into two 605-MVAR synchronous condensers, which steady the grid by spinning. Type One&#8217;s Infinity One takes the other slot: a prototype stellarator built to fire frozen hydrogen pellets into a plasma and prove the magnets hold, with commissioning and startup scheduled for 2029, and no electricity coming out of it by design.<\/p>\n<p>Infinity Two is the machine this license exists for. Type One listed it at 350 megawatts electric in its January application announcement, and TDEC&#8217;s August 31 release lists it at 400. At 400 megawatts, Infinity Two would put out a little over half of the 765 megawatts the coal unit managed on a summer day. The Knoxville-based company says it intends to break ground on the first phase of Project Infinity this year, and TDEC&#8217;s release holds full startup to 2034.<\/p>\n<h2>The twisted machine Oak Ridge has been feeding since the 1970s<\/h2>\n<p>A tokamak confines its plasma inside a smooth donut and drives a huge current through the gas itself to complete the magnetic cage. A stellarator skips the plasma current and does all the confinement with external coils bent into shapes no human could draft by hand, which trades a fabrication nightmare for a machine that runs steady and cannot lose its own field in a disruption. Germany&#8217;s Wendelstein 7-X held a high-performance plasma for <a href=\"https:\/\/www.autonocion.com\/us\/german-fusion-machine-donut-shaped\/\" target=\"_blank\" rel=\"noopener\">43 seconds<\/a> on exactly that principle. Type One started as a University of Wisconsin-Madison spinoff, and the same campus built one of the first optimized stellarators back in the 1990s. The company later planted itself in Tennessee, a few miles from the lab that solved the feeding problem.<\/p>\n<p>That lab is Oak Ridge National Laboratory, and the feeding problem is real: a fusion plasma at roughly 180 million degrees Fahrenheit (100 million Celsius) burns through fuel constantly, and blowing gas at its edge barely reaches the core. ORNL <a href=\"https:\/\/www.ornl.gov\/news\/ornl-type-one-energy-advance-fusion-fuel-cycle-innovative-new-technologies\" target=\"_blank\" rel=\"noopener nofollow\">licensed four of its cryogenic pellet fueling inventions<\/a> to Type One on August 5, at a signing in Knoxville. The suite includes a tritium-compatible gas gun, a screw extruder that freezes fuel into solid pellets, a relief valve rated for service below 20 kelvin (minus 423.7 degrees Fahrenheit), and a closed-loop system that recycles unused fuel back into the line. The pellets are frozen hydrogen. The gun shoots them into the plasma at high speed, deep enough to actually feed the burn, and ORNL has been refining the trick since inventing it in the 1970s.<\/p>\n<p>Troy Carter, director of ORNL&#8217;s Fusion Energy Division, described the licensed hardware to <a href=\"https:\/\/www.teknovation.biz\/ornl-hands-a-50-year-fusion-fueling-breakthrough-to-type-one-energy\/\" target=\"_blank\" rel=\"noopener nofollow\">Teknovation<\/a> as &#8220;a gas gun technology, where you inject ice pellets in.&#8221;<\/p>\n<h2>A byproduct license is permission to start, not proof it works<\/h2>\n<p>The license lets Type One possess and use the radioactive materials a commercial fusion machine involves, tritium above all, under state inspection at the Bull Run site. A byproduct material license sits nowhere near the operating license a fission reactor needs, and the NRC set it up that way on purpose, because a fusion machine cannot melt down and holds no chain reaction to lose control of. The paper says the safety case for handling the fuel checks out. The paper says nothing about whether the machine will ever pay for itself.<\/p>\n<p>The physics gap stays open too. No fusion company anywhere has delivered net electricity to a grid, and that includes every name in this story. Type One closed an $82.4 million seed round in March 2025, added a reported $87 million convertible note in January that took its total past $160 million, according to The Fusion Report, and has been one of eight companies inside the Department of Energy&#8217;s Milestone-Based Fusion Development Program since May 2023, a $46 million federal pot the participants match with more than half the cost from their own pockets. Money buys magnets and coil winders. A grid connection still has to be earned shot by shot, pellet by pellet, in a hall that spent five decades earning it with coal.<\/p>\n<p>TDEC dated its announcement August 31, 2026, three years after Bull Run burned the last of its coal pile in August 2023. Type One says the first shovel goes into the ground before the year is out, and Infinity One&#8217;s pellet guns are due to start firing in 2029.
